There are broadly 3 types of licences for B&B’s/guesthouses:
1) Alojamento Local (AL)
Within Alojamento Local you’ll find the following categories: Rooms, Apartments, Houses and Guesthouses. For this purpose, the license for guesthouse (“estabelecimento de hospedagem” - EH) is the relevant one. This license is capped to 9 rooms or 30 guests. EH are subject to a series of simple exploration conditions, (including fire risk if < 11 guests). Application is made online subject to a 60 day period (90 days in case of contention area during which time the townhall will make a vistoria. EH can incorporate other commercial activities like restauration and/or bar. The categories EH and Rooms can use the commercial name of Bed&Breakfast or guesthouse.
Some geographical areas are limited in issuing new AL licences
2) Turismo no Espaço Rural (TER)
Here the different categories are: Casas de Campo, Agro-turismo and Rural Hotels. Casas de Campo are defined as houses/properties which are of typical architecture for the region. Agri-turismo are lodgings integrated in working farms. For Casa de Campo, the maximum capacity is defined by the number of fixed beds. Breakfast is obligatory as is daily cleaning of rooms. Lunch and dinner are obligatory in case restaurants are > 5 km away and the owner living onsite. As this is a commercial enterprise, it is subject to more extensive legislation, including fire risk mitigation, pool safety & maintenance, HCCAP, prevention plan for legionella, etc
3) Turismo de Habitação (TH)
Lodgings in family environment or in historical buildings like palaces and solar. Suited for houses in towns. Only ensuite rooms are allowed.
